GEM11.TCG Terms of Use

These Terms of Use (“Terms”) are a legal agreement between you and GEM11.TCG, doing business as GEM11.TCG (“GEM11,” “we,” “us,” or “our”). They govern your access to and use of gem11tcg.com and GEM11’s related product-discovery, availability, watchlist, alert, community-reporting, and account services (collectively, the “Service”).

Please read these Terms carefully. By creating an account, selecting a button that indicates acceptance, or otherwise using an account-based part of the Service, you agree to these Terms. If you do not agree, do not create an account or use account-based features.

Nothing in these Terms limits a consumer right or remedy that cannot lawfully be waived.

1. Who operates GEM11

The Service is operated by:

2. Eligibility

You must be at least 13 years old to create an account or contribute to the Service. If you are under the age of majority where you live, you confirm that your parent or legal guardian has reviewed these Terms with you and permitted you to use the Service.

If you use the Service for a business, retailer, organization, or another person, you represent that you have authority to bind them to these Terms.

The Service is intended for users in Canada. Certain features, retailers, or information may be limited to specific provinces, cities, or locations.

3. What the Service does

GEM11 helps collectors discover trading-card products and view recent price and availability signals from retailers, public sources, and community members. Depending on availability, the Service may let you:

• Browse products, retailers, prices, and sightings.
• Maintain a watchlist and alert rules.
• Receive in-app or separately authorized notifications.
• Submit, confirm, dispute, or update sightings.
• Provide feedback about whether a product was found or purchased.
• Build community-reputation indicators based on contribution history.

The Service is an information and community platform. GEM11 is not the seller of products listed through the Service and does not take possession of them. Unless we expressly say otherwise at the point of sale, GEM11 is not a retailer, marketplace, broker, reseller, agent, or representative of a linked retailer.

4. Accounts and Discord sign-in

Some features require an account authenticated through Discord. You agree to:

• Provide accurate information and keep profile information reasonably current.
• Maintain control of your Discord account and the devices and browser sessions used to access GEM11.
• Not share, sell, transfer, or permit unauthorized use of your GEM11 account.
• Notify us promptly at gem11.tcg@gmail.com if you suspect unauthorized access.
• Comply with the terms that apply to your use of Discord.

We do not receive your Discord password. You authorize us to receive the basic Discord account information shown during authorization and to use it as described in our Privacy Policy.

You are responsible for activity performed through your account unless caused by our failure to use legally required safeguards.

5. Availability, price, and confidence information

Inventory moves quickly. Sightings may come from retailer feeds, store staff, community members, public sources, or automated detection. A listing, sighting, confidence label, quantity estimate, price, or alert may be incomplete, misclassified, delayed, duplicated, stale, or incorrect.

In particular:

• “Confirmed,” “likely,” or another confidence label represents GEM11’s assessment of available evidence, not a guarantee.
• A retailer page may remain online after inventory has sold out.
• Online availability does not necessarily mean that a nearby physical store has stock.
• Prices may exclude taxes, shipping, deposits, membership requirements, or retailer-specific conditions.
• A product image may be illustrative, and product names or package types may be supplied or changed by a third party.
• A retailer controls the actual price, inventory, eligibility, allocation, purchase limit, fulfilment, cancellation, return, and warranty terms.

Always confirm important details directly with the retailer before travelling or purchasing. GEM11 is not responsible for fuel, travel, time, missed opportunities, retailer cancellations, price differences, or a product being unavailable when you arrive, except to the extent responsibility cannot lawfully be excluded.

6. Alerts and notifications

Alerts are provided on a best-efforts basis. Delivery may be delayed, blocked, duplicated, or missed because of data latency, provider outages, device settings, filtering, rate limits, incorrect alert rules, or other factors.

Creating an alert does not reserve a product, guarantee notice before other users, or guarantee availability or price. You remain responsible for verifying the information and deciding whether to visit or purchase from a retailer.

You can pause or delete alert rules through your account. Communication-channel choices and unsubscribe rights are also described in our Privacy Policy and in the message where applicable.

7. Community contributions

“Contribution” means a sighting, confirmation, dispute, price, quantity estimate, photograph, note, feedback response, correction, or other content you submit to the Service.

You retain ownership of original content in your Contributions. You grant GEM11 a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, adapt for technical or accessibility purposes, display, distribute through the Service, analyze, verify, moderate, and create aggregated or de-identified information from each Contribution. This licence exists only to operate, secure, explain, promote, and improve the Service.

The licence ends when the Contribution is deleted from our active systems, except that:

• Cached and backup copies may remain for a limited period.
• A factual sighting and related confidence history may remain without being linked to your account after you delete the account.
• Aggregated or de-identified information may be retained.
• We may retain information where reasonably necessary for security, legal compliance, fraud prevention, or dispute resolution.

For each Contribution, you represent that:

• It is honest and, to the best of your knowledge, accurate and current.
• You have the rights and permissions needed to submit it and grant the licence.
• It does not invade privacy, disclose confidential information, or infringe intellectual-property or other rights.
• It does not contain personal information about another person unless you have a lawful reason and any required permission.
• It complies with these Terms and applicable law.

Do not upload a photograph that prominently identifies another customer, a minor, a vehicle licence plate, payment information, a receipt containing personal information, or a store employee without appropriate permission.

8. Acceptable use

You must not use the Service to:

• Submit a false, fabricated, manipulated, or intentionally misleading report.
• Manipulate confidence, reputation, voting, alerts, rankings, or availability.
• Impersonate a retailer, employee, community member, or other person.
• Hide a commercial relationship, promote your own inventory as an independent sighting, or submit undisclosed sponsored content.
• Harass, threaten, exploit, or publish personal information about another person.
• Advertise or facilitate counterfeit, stolen, fraudulent, or unlawful goods.
• Scrape, crawl, copy, or use automated means to access the Service except as expressly permitted in writing or through a published interface.
• Circumvent access controls, feature limits, rate limits, or security measures.
• Probe, scan, exploit, disrupt, overload, introduce malicious code into, or interfere with the Service or another user’s access.
• Reverse engineer a non-public portion of the Service except where applicable law expressly permits it despite this restriction.
• Use GEM11 data to build or train a competing product or dataset without our written permission.
• Violate applicable law or assist another person in doing so.

Reasonable personal, non-commercial use of public product information is permitted. Contact gem11.tcg@gmail.com to request API, research, retailer, or commercial access.

9. Moderation, corrections, and reputation

We may review, label, reduce the confidence of, correct, restrict, or remove a Contribution when we reasonably believe it is inaccurate, stale, unlawful, unsafe, abusive, commercially manipulated, or contrary to these Terms. We may also preserve a disputed record with a correction or provenance label when that better protects the integrity of the dataset.

Reputation and confidence indicators are automated or editorial assessments based on available evidence. They are not statements about a person’s character and are not guaranteed to be error-free. You may ask us to review an indicator or correction by contacting gem11.tcg@gmail.com.

We are not required to pre-screen every Contribution and do not endorse a Contribution merely because it appears in the Service.

10. Retailers and other third-party services

Links are provided for convenience and verification. When you leave GEM11, the retailer or other third party controls its service. Your purchase and any delivery, refund, return, warranty, loyalty program, dispute, or personal- information handling are governed by your agreement with that third party.

GEM11 is not affiliated with, endorsed by, or sponsored by a retailer, game publisher, platform, or trademark owner merely because its name, product, data, or link appears in the Service.

If GEM11 receives compensation or another material benefit from a link, result, or placement, we will provide a clear disclosure in proximity to the affected content. Compensation will not convert a retailer into our agent or make GEM11 the seller of its products.

11. GEM11 and third-party intellectual property

The Service—including its software, design, branding, selection and arrangement of content, and original materials—is owned by GEM11 or its licensors and is protected by intellectual-property law. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for personal purposes.

GEM11.TCG and associated names, logos, and visual elements may be trademarks of GEM11. You may not use them in a manner that suggests sponsorship, endorsement, or affiliation without written permission.

Product, retailer, game, character, publisher, and platform names and marks belong to their respective owners. Their appearance is for identification and informational purposes and does not imply affiliation or endorsement.

If you believe material in the Service infringes a right you own, contact gem11.tcg@gmail.com with enough detail for us to identify and evaluate it.

12. Feedback

If you send an idea or suggestion about GEM11, you permit us to use it without restriction or compensation. This does not transfer ownership of a Contribution or personal information, which remain governed by sections 7 and 15.

13. Free and paid features

Some features may be free, limited, offered for a trial period, or available only under a paid plan. Feature limits may differ by account or plan and will be shown in the Service.

Before charging you, we will clearly present the applicable price and currency, taxes, billing frequency, renewal terms, included features, trial conversion, cancellation method, refund terms, and any material restrictions. We will not charge a payment method without your express authorization.

14. Suspension, termination, and account deletion

You may stop using the Service at any time and may delete your account through account settings.

We may restrict or suspend an account or Contribution when reasonably necessary to investigate suspected misuse, protect users or the Service, comply with law, or prevent material harm. We may terminate access for a material or repeated breach of these Terms. Where reasonable, we will give notice and an opportunity to appeal or correct the issue, but immediate action may be necessary for security, fraud, unlawful activity, or safety.

If we discontinue the account-based Service, we will provide reasonable notice where practicable and explain available deletion or export options.

Account deletion and information that may remain in de-identified form are described in the Privacy Policy. Provisions that by their nature should survive termination—including accrued payment obligations, licences for retained de-identified information, intellectual-property provisions, disclaimers, liability limits, and dispute terms—will survive.

15. Privacy

Our Privacy Policy explains how we handle personal information. It forms part of the information provided to you when you use the Service but is not intended to turn every statement in that policy into a contractual warranty.

16. Service changes and availability

We may add, change, suspend, or discontinue a feature to improve the Service, respond to security or legal requirements, manage third-party dependencies, or reflect business needs. We will provide reasonable advance notice when a change materially reduces a paid feature, except when urgent action is needed for security, legal compliance, or circumstances outside our control.

We do not promise that the Service will always be available, uninterrupted, secure, or error-free. Maintenance, retailer changes, Internet failures, provider outages, and events outside our reasonable control may affect it.

17. Disclaimers

To the maximum extent permitted by applicable law, the Service and all product, retailer, price, availability, confidence, alert, and community information are provided “as is” and “as available.” GEM11 disclaims warranties and conditions not expressly stated in these Terms, including implied warranties or conditions of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted availability.

GEM11 does not provide financial, investment, appraisal, authentication, grading, legal, or professional advice. Product prices and availability are not valuations or predictions. You are responsible for purchase, travel, resale, collection, and other decisions made using the Service.

Some jurisdictions do not permit particular disclaimers. In that case, the affected disclaimer applies only to the maximum extent permitted, and your non-waivable rights remain in effect.

18. Limitation of liability

To the maximum extent permitted by applicable law, GEM11 and its directors, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunity, lost data, loss of goodwill, travel expense, or the cost of substitute services arising from or related to the Service.

To the maximum extent permitted by applicable law, GEM11’s total liability for all claims arising from or related to the Service during any 12-month period will not exceed the greater of:

1. The amount you paid directly to GEM11 for the Service during that period; or
2. CAD $100.

These limitations do not apply to liability that cannot lawfully be limited, including liability arising from fraud, wilful misconduct, or any other matter for which applicable law prohibits exclusion or limitation. The limitations apply regardless of the form of action and even if a remedy fails of its essential purpose, to the extent permitted by law.

19. Responsibility for unlawful use

To the extent permitted by applicable law, you are responsible for losses and reasonable costs incurred by GEM11 as a direct result of your unlawful Contribution, wilful misuse of the Service, or material breach of sections 7 or 8. GEM11 will give you prompt notice of a third-party claim and will not settle a claim in a manner that imposes an admission or non-monetary obligation on you without your consent.

This section does not apply to a consumer where, or to the extent, applicable consumer law prohibits it.

20. Governing law and disputes

Before starting a formal claim, you and GEM11 agree to try in good faith for 30 days to resolve the matter by written notice. Send a notice to gem11.tcg@gmail.com; we will send notices to the email associated with your account. Either party may seek urgent injunctive or protective relief without waiting 30 days.

Except where the law of your province or territory requires otherwise, these Terms are governed by the laws of Manitoba and the federal laws of Canada applicable there, without regard to conflict-of-law principles. Subject to your non-waivable right to bring a claim elsewhere, the courts located in Winnipeg, Manitoba will have jurisdiction.

Nothing in this section prevents you from making a complaint to a consumer, privacy, competition, or other regulator with jurisdiction.

21. Changes to these Terms

We may update these Terms to reflect changes to the Service, our business, or the law. We will post the updated version, change the “Last updated” date, and provide reasonable notice of a material change. Where required, we will ask you to accept the updated Terms before continuing to use account-based features.

Changes do not retroactively alter a dispute that arose before the updated Terms took effect unless both parties agree or applicable law requires it.

22. General terms

If a provision is unenforceable, it will be limited or removed only to the minimum extent necessary, and the remainder will continue in effect. Our delay in enforcing a provision is not a waiver. You may not transfer these Terms or your account without our consent. We may transfer these Terms as part of a merger, financing, reorganization, or sale of the relevant business, subject to applicable law and the Privacy Policy.

These Terms, the Privacy Policy, and any additional terms clearly presented for a specific feature or purchase are the entire agreement concerning the Service. If specific additional terms conflict with these Terms, the specific terms control for that feature or purchase.

Headings are for convenience only. “Including” means “including without limitation.” Electronic notices and records may satisfy a writing requirement where permitted by law.
